The Sunoco® / Orange County Choppers™ Custom Chopper Giveaway 2007 Official Rules No Purchase Required to Enter or Win. A Purchase Does Not Increase Your Chances of Winning. Void in CA, MD, NJ, VA, and outside the Continental U.S., and Where Prohibited. 1. ELIGIBILITY: The Sunoco/Orange County Choppers Custom Chopper Giveaway sweepstakes (the “Sweepstakes”) is open only to legal residents of the continental U.S, who are 18 years of age or older at the time of entry, except residents of CA, MD, NJ and VA, who are not eligible to participate. Void in CA, MD, NJ, and VA, outside the continental U. S., and where prohibited. Sweepstakes entrants must have had internet access prior to September 1, 2007. Employees, officers and directors of Sunoco, Inc. (R&M) (“Sunoco”), Orange County Choppers, Inc., Logistix Marketing, Inc., and each of their respective parent, subsidiary, or affiliated companies, franchisees, dealers, distributors, driver organizations, broadcast stations, promotional or fulfillment agencies (collectively, “Sweepstakes Entities”), National Association for stock Car Auto Racing, Inc. (“NASCAR”), its affiliates and their respective employees, shareholders, directors, officers and agents, as well as members of the immediate families (defined for these purposes as including spouse, parents, siblings, and children, and each of their respective spouses) or households (whether related or not) of any of the above are NOT eligible to participate. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. 2. SPONSOR AND ADMINISTRATOR: Sweepstakes is sponsored by Sunoco, Inc. (R&M), 1735 Market Street, Philadelphia, PA 19103 (“Sponsor”). Sweepstakes is administered by Logistix Marketing, Inc., 6330 San Vicente Blvd., Los Angeles, CA 90048, an independent judging organization (“Administrator”). 3. AGREEMENT TO OFFICIAL RULES: By participating in the Sweepstakes, entrant (or his/her parent or legal guardian if entrant is 18 or older but considered a minor in his/her state of residence) warrants that he/she fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor. Winning a prize is contingent upon verification of eligibility and fulfillment of all requirements set forth herein in a timely manner. 4. SWEEPSTAKES PERIOD: The Sweepstakes begins on 9/1//07 and ends at 11:59:59 p.m. EST on 10/31/07 (“Sweepstakes Period”). See Rule 6, below, for online entry deadline. Entries submitted after the deadline set forth in these Official Rules are void. 5. HOW TO GET YOUR HERO CARDS: Four (4) different Sunoco/Orange County Choppers Hero Cards (“Hero Cards”) will be available during the Sweepstakes Period. You must collect each of the four different Hero Cards in order to enter (see details of How To Enter in Rule 6, below). You may obtain one (1) Hero Card with each purchase of at least ten (10) gallons of Sunoco® Gasoline during the Sweepstakes Period. For the period 9/1/07 through 9/30/07, a different card will be available during each week (while supplies last). Week 1 of that period begins on 9/1/07 and ends on 9/8/07; Week 2 begins on 9/9/07 and ends on 9/15/07; Week 3 begins on 9/16/07 and ends on 9/22/07; and Week 4 begins on 9/23/07 and ends on 9/30/07. For the period 10/1/07 through 10/31/07, each of the four (4) Hero Cards will be available at participating Sunoco locations (while supplies last). To obtain a complete set of four (4) Hero Cards without making a purchase, hand print your name, complete address, birth date and evening telephone number on a 3”x5” card or piece of paper and mail it in an envelope with proper postage affixed to: Sunoco/OCC Custom Chopper Hero Cards, c/o Logistix Marketing, Inc., P.O. Box 781298, Indianapolis, IN 46268. Limit of one (1) set of Hero Cards per envelope. Mail-in requests must be postmarked no later than 10/31/07 and received by 11/7/07. Hero Cards will only be available while supplies last. Mail–in requests for Hero Cards will be fulfilled via US regular mail beginning 10/1/07. Please allow approximately 5-7 days to fulfill mail-in requests. Requests will not be acknowledged (other than by sending you the Hero Cards) or returned. Proof of sending will not be deemed proof of receipt by Administrator. No mechanical or other reproductions of Hero Card requests will be accepted. 6. HOW TO ENTER: Entry into the Sweepstakes will be done online only. Participants must collect all four (4) different Hero Cards and line up the corners on the reverse side of each Hero Card to reveal the special SUNOCO image in the center. Log on to www.SunocoChopper.com and select the image that matches your special image. After logging on and selecting the correct matching image to the Hero Cards, you will be automatically linked to the Sweepstakes entry page and instructed to complete and submit required information in order to be entered into the Sweepstakes’ Grand Prize Drawing (“Entry”) (see details of Drawing in Rule 8, below). Limit one (1) Entry per person/email address. If more than one entry is received per person or email address, all entries received from that person/email address will be disqualified. You must be the registered and Authorized Account Holder of the e-mail account through which the Entry is made. "Authorized Account Holder" is defined as the natural person who is assigned to an e-mail address by an internet service provider, or other organization (e.g., business or educational institute) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. In the event of a dispute as to ownership of an Entry, entrant may be required to provide proof of ownership of the e-mail account used to enter the Grand Prize drawing. If it is determined that such entrant is not the authorized account holder as defined herein, the entrant will be disqualified. Entry must be made by and from a single computer and may not be made by proxy, or automated means such as by script, bot, macro or any other similar software or program. To be eligible for inclusion in the Grand Prize drawing, all online Entries must be received by 11:59:59 p.m. EST on 11/20/07. All Entries received become Sponsor’s property and will not be returned. Proof of submission of an entry will not constitute proof of receipt by Sponsor. 7. GRAND PRIZE: One (1) Grand prize will be awarded, consisting of one (1) Orange County Choppers customized chopper. Sponsor will determine all features of the prize except for the paint scheme and colors, which winner will choose (subject to selection limitations). The Approximate Retail Value (“ARV”) of the Grand Prizes is $40,000. Only one (1) Grand Prize will be awarded. 8. THE GRAND PRIZE DRAWING: A random drawing to select the Grand Prize winner will be held on or about November 26, 2007 from among all eligible Entries received in accordance with these Official Rules. The drawing will be conducted by the Administrator, whose decisions shall be final and binding in all matters relating to this Sweepstakes. 9. ODDS OF WINNING GRAND PRIZE: The odds of winning the Grand Prize depend on the number of eligible Entries received. 10. WINNER NOTIFICATION: The potential Grand Prize winner will be notified by telephone and/or e-mail prior to December 15, 2007, or as soon thereafter as possible. Return of the prize notification or prize as undeliverable may result in disqualification and selection of an alternate winner in a random drawing from among the remaining eligible Entries. 11. VERIFICATION OF ELIGIBILITY: The potential Grand Prize winner will be required to submit the four (4) winning Hero Cards and to complete and return an affidavit of eligibility and liability/publicity release (where permitted) (“Eligibility Affidavit-Release”) that will be provided to the potential winner during the prize redemption process. Eligibility Affidavit-Release must be completed, submitted together with the four (4) winning Hero Cards, and postmarked within ten (10) days after receipt by potential Grand Prize winner, and received by Sponsor or Administrator (as applicable) within ten (10) days thereafter, or prize may be forfeited and awarded to an alternate winner in a random drawing from among all remaining eligible Entries. If Grand Prize winner is 18 or older, but considered a minor in winner’s state of residence, winner’s parent or legal guardian must accept the prize on winner’s behalf and sign the required Eligibility Affidavit-Release. Upon verification of winner’s compliance with these Official Rules, Sponsor will return the four (4) winning Hero Cards to winner. 12. GENERAL PRIZE AWARDING: UPON COMPLETION OF VERIFICATION PROCESS, Please allow approximately four (4) to six (6) weeks after the color/paint scheme have been finalized with OCC for delivery of the Grand Prize. Delivery of the Grand Prize will be made to, and prize must be picked up at a Sunoco retail location designated by Sunoco with winner’s residence taken into consideration. All expenses related to the use of the prize are the winner’s responsibility. The prize must be accepted as awarded and is non-transferable. No other cash redemption or prize substitution may be made, except by Sponsor, who reserves the right, in its sole discretion, to substitute the Grand Prize with another prize of greater or equal value in the event the advertised Grand Prize is unavailable. The winner is responsible for any applicable taxes associated with receipt of the prize, and an IRS Form 1099 reflecting the value of the prize will be issued at the end of the calendar year to the Grand Prize winner. The prize will be awarded provided it is claimed properly in accordance with these Rules. 13. PUBLICITY: Except as to residents of TN and where otherwise prohibited, participation in the Sweepstakes constitutes entrant’s (or entrant’s parent’s or legal guardian’s, if applicable) consent to Sponsor’s and its agents’ use of entrant’s name, likeness, voice, opinions, biographical information and state of residence for promotional and trade purposes in any media worldwide without limitation, payment or consideration, and without additional notice. 14. GENERAL CONDITIONS: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes if any fraud, infection by computer virus, worms, bugs, tampering, hacking, unauthorized intervention, technical failures, printing, technical or human errors or other problem corrupts the administration, security, or proper play of the Sweepstakes, as determined by Sponsor or the Administrator in their sole discretion. In the event the Sweepstakes is terminated before the stated end date, Sponsor reserves the right to award the prize in a random drawing from among the eligible, non-suspect Entries received up to the time of the impairment causing the early termination. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with or attempting to tamper with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules. Any attempt by any person to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. By participating, entrants (or their parents/legal guardians, if applicable) agree to be contacted by Sponsor or its agents in any permissible manner. 15. RELEASE: By participating in the Sweepstakes, each entrant (or his/her parent/legal guardian, if applicable) agrees to release and hold harmless Sponsor, Administrator, NASCAR, Inc., its affiliates and their respective employees, shareholders, directors, officers and agents, and each of the Sweepstakes Entities, whether specifically named or not in these Official Rules, their respective agents, and any of their respective directors, employees and officers, Evernham Motorsports, LLC, Valvoline Evernham Racing, LLC, JR Motorsports, LLC, and their respective members, managers and affiliates, Dale Earnhardt, Jr., Ray Evernham, Bill Elliott, Kasey Kahne, Elliott Sadler, Erin Crocker and Scott Riggs, and their respective parent companies, subsidiaries, divisions, affiliates, suppliers, distributors and advertising, promotional and judging agencies and each of their respective officers, directors, shareholders, members, employees, agents, assigns, and all others associated with the development and execution of this Sweepstakes (collectively, the “Released Parties”) from and against any liability whatsoever, and waives any and all causes of action, related to any claims, costs, injuries, losses, or damage of any kind, including without limitation, personal injury, death, or damage to, or destruction of, property arising out of or in connection with participation in the Sweepstakes or the delivery, misdelivery, acceptance, possession, use, misuse, or inability to use the prize (if awarded to him/her), or while preparing for, participating in or traveling to or from any prize-related activity, or any typographical or other error in these Official Rules or the announcement of the winner, whether intentional or unintentional, and whether under a theory of contract, tort (including negligence), warranty or other theory. The Released Parties are not responsible for any: (a) unauthorized human intervention in any part of the Sweepstakes; (b) errors of any kind which may occur in the administration of the Sweepstakes or in the transmission, receipt or processing of Entries ; (c) computer, telephone, cable, satellite, network, electronic or online/Internet hardware or software malfunctions, failures, connections or availability, or garbled or jumbled transmissions, or service provider/Internet/Web site use, accessibility or availability, or traffic congestion, or other errors of any kind whether human, mechanical, electronic or network, or the incorrect or inaccurate transmission or capture of Entry or other information, or the failure to capture, or loss of, any such information; (d) entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, or misdirected; (e) entries submitted in a manner that is not expressly allowed under these rules; or (f) typographical or other error in the printing or advertising of the offer, administration or execution of the Sweepstakes, or in the announcement of the prize winner. The Released Parties have no responsibility in the event the Eligibility Affidavit-Release, prize notification or Hero Card requests are late, lost, illegible misdirected, damaged, incomplete, or postage-due. Neither Evernham Motorsports, LLC , Valvoline Evernham Racing, LLC, JR Motorsports, LLC, their respective members, managers or affiliates, Dale Earnhardt, Jr., Ray Evernham, Bill Elliott, Kasey Kahne, Elliott Sadler, Erin Crocker, Scott Riggs nor NASCAR, Inc., its affiliates and their respective employees, shareholders, directors, officers and agents is responsible for any aspects of the Sweepstakes and they assume no responsibility or liability with respect thereto. 16. DISPUTES: Except where prohibited, by participating, entrant (or his/her parent/legal guardian, if applicable) agrees that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Pennsylvania; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys’ fees; and (c) entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Pennsylvania, without giving effect to any choice of law or conflict of law rules. 17.
